SUMMARY

  • A court in Larimer County, Colorado preliminarily approved a class action settlement in a class action lawsuit involving Harmony Road, LLC, RHP Properties, Inc., and other RHP-Branded mobile home parks in Colorado. The lawsuit contends that RHP-branded mobile home parks implemented certain Community Guidelines related to the towing of cars and other vehicles that may have run afoul of Colorado law. The Defendants deny all allegations and any breach of the law, and the Court has not determined who is right. The parties have settled their dispute.

  • You may be a Settlement Class Member if you resided at any of the Defendants’ Parks in Colorado from July 26, 2019, to April 15, 2024.

  • Defendants have agreed to pay $850,000 into a Settlement Fund to pay Settlement Class Members, who do not request to be excluded, their share of the Settlement Fund after deducting the costs of any court approved charges for notice and administration, attorneys’ fees, and any Incentive Award. There are 3 Settlement Groups. You may belong to more than 1 group. You do not need to act to receive a Group 1 payment. You must file a Claim Form to receive a Group 2 or Group 3 payment.

  • As described in more detail in the Notice, Settlement Class Members may:

    1. Do nothing, in which case you will receive a Settlement payment, and give up certain legal claims you have;

    2. File a Claim Form, meaning you will receive an additional Settlement payment and give up certain legal claims you have;

    3. Object to the Settlement;

    4. Request to be excluded from the Settlement and not receive a Settlement payment.

  • Before any money is paid, the Court must first decide whether to grant Final Approval of the Settlement
